摘要目前各个网络集资平台都在加强风险防控，网络集资环境趋于完善。作为投资者和市场管理者来说担心集资平台非法集资，而能否偿还投资者的本息是集资者面临的最大问题。究其原因是网络集资平台一方面没有可供继续经营的实业，而另一方面是其信誉崩塌，从而导致不可逆的后果。因此，无论是从保护投资者利益的角度，还是从维护互联网金融秩序的角度，互联网非法集资调查都是非常必要的。本文先从网络环境下非法集资的概况入手，接着分析网络环境下非法集资的刑法认定问题，同时借鉴德国、美国等对网络环境下非法集资的规制，最后从三个方面即立法、执法和司法给出完善建议。关键词：互联网金融：非法集资：非法占有目的：刑法规制IAbstractAt present,the network financing environment has the tend of improvement,the financingplatform is also strengthening risk prevention and control.The biggest risk for fund-raisers iswhether they can repay their investors'principal and interest.Investors and market managersworry about illegal financing.Because in the network environment,illegal fund-raising is oftenirreversible,on the one hand,its credibility collapsed,on the other hand,there is no business forit to continue to operate.Therefore,whether from the perspective of protecting the interests ofinvestors or maintaining the financial order of the Internet,the investigation of illegalfund-raising on the Internet is very necessary.This paper starts with the general situation ofillegal fund-raising under the network environment and then analyzes the network Criminallaw identification problem of illegal fund-raising under the network environment,at the sametime draw lessons from the criminal law regulation of illegal fund-raising outside the country,finally give the perfect suggestion from three aspects:legislation,law enforcement andjudicature.Key words:Online finance;illegal fund-raising;purpose of illegal possession;criminal lawregulation
