论我国刑法中完全无责任年龄的限定问题研究摘要：随着中国政治、经济、文化等不断发展起来，我国未成年人的生理、心理成长也根据时代以及中国的发展变得“早熟”起来。近年来我国完全无责任年龄刑事犯罪的未成年人恶性案件频发的现状，可以看出我国刑事犯罪年龄低龄化的趋势越来越突出。我国刑法把刑事责任年龄分为三个阶段：完全责任年龄、完全无责任年龄、相对责任年龄，本篇论文主要论述完全无责任年龄，即不满14周岁的人为完全无责任年龄，对任何危害行为都不负刑事责任，所以又称为绝对无责任年龄或者完全无责任年龄。尤其是以2019年10月底发生的大连10岁女孩被杀案为中心讨论点的恶性案件再度引发学界和社会民众对于是否应该降低最低刑事责任年龄的热烈讨论。根据大连10岁女孩被杀案引发的热点争议中心进行法律问题研究，即对于我国刑法中完全无责任年龄的制度现状以及是否适当降低调整或维持现行制度进行法律研究，本文通过对制度、文献以及案例试图研究得到一个在应然和实然层面都可行的方案。首先，本文通过详细讨论大连10岁女孩被杀案的恶性案件，再引用其他关于完全无责任年龄的案件，分析说明学界和社会民众对于最低刑事完全无责任年龄的热点讨论。其次，根据刑事完全无责任年龄的热点争议中心即对于刑法中完全无责任年龄是否适当降低调整还是维持现行制度的不同的观点进行介绍，并在结合我国刑事完全无责任年龄现有的制度以及其存在立法不足之处，还有我国的发展和当代世界各国对于该制度的主要发展趋势，从中研究得出是否应该降低刑事完全无责任年龄的结论。最后，根据通过对制度、文献以及案例的研究，总结关于完全无责任年龄制度的立法不足之处，合理完善符合现代我国国情在刑法中关于该制度的立法缺陷之处，提出合理的方案，并力竭研究如何从源头预防、遏制未成年人恶性案件频发的现状，在打击未成年人犯罪的同时完善我国刑法中关于完全无责任年龄的法律制度，发挥法律的引导和教育的作用。关键词：完全无责任年龄降低最低刑事无责任年龄恶性案件未成年人A Study on the Limitation of the Age of Total Responsibilityin China's Criminal LawAbstract:With the continuous development of Chinese politics,economy,and culture,thephysical and psychological growth of Chinese minors has become "precocious"according to thetimes and the development of China.In recent years,the current situation of vicious cases ofminors in criminal offenses at the age of absolutely no liability in our country is frequent.It can beseen that the age of criminal offenders in our country has become increasingly prominent.China'scriminal law divides the age of criminal responsibility into three stages:the age of fullresponsibility,the age of total non-responsibility,and the age of relative responsibility.This papermainly discusses the age of total non-responsibility.They are not criminally responsible,so theyare also known as the age of absolute responsibility or the age of absolute responsibility.Especially the vicious case centered on the murder of a 10-year-old girl in Dalian at the end ofOctober 2019 has once again sparked heated discussions in the academic community and thepublic about whether the minimum age of criminal responsibility should be reduced.According tothe hot controversy center caused by the 10-year-old girl's murder in Dalian,the legal issues areresearched,that is,the legal status of the completely irresponsible age system in China's criminallaw and whether it is appropriate to reduce or adjust the current system.The case attempts to studya solution that is feasible at both the expected and actual levels.First,this article discusses in detail the vicious case of the 10-year-old girl's murder in Dalian,and then cites other cases conceming the age of total non-responsibility.Secondly,according tothe hot dispute center of the age of total criminal liability,that is,the different viewpoints ofwhether the age of total criminal liability is appropriately reduced or maintained in the criminallaw,and the existing system of the age of total criminal liability in China and its There arelegislative deficiencies,as well as the development of our country and the main developmenttrends of the system in the countries of the contemporary world,from which we can concludewhether we should reduce the age of total criminal liability.Finally,based on the study of thesystem,literature,and case studies,summarize the legislative deficiencies of the age of thecompletely unresponsible system,reasonably improve the legislative deficiencies of the system inthe criminal law in line with modem national conditions,and propose a reasonable plan,andExhaustively study how to prevent and curb the current situation of the vicious cases of minorsfrom the source.While cracking down on minor crimes,improve the legal system of the age oftotal responsibility in our criminal law and give play to the role of legal guidance and education.Keywords:Age of Total Responsibility Reduce Minimum Age of Criminal ResponsibilityMalignant Cases Minors
