成绩等级安本科毕业论文（设计）题目建设工程项目索赔与技巧学院专业班级学号学生姓名指导教师完成日期西安思源学院教务处制中文摘要建设工程项目索赔的概念有广义和狭义的区分，广义的建设工程项目索赔既包括承包商向业主进行的索赔，也包括业主向承包商进行的索赔。狭义的索赔仅指承包方因非自身原因造成工期延长、费用增加而向业主进行的索赔。本文所述的建设工程项目索赔仅指狭义的索赔。随着经济的飞速发展，工程建设承包的国际化程度不断加深，与其相关的工程项目索赔案件不断增加，这反映出了我国相应的体制与法规并不完善。我国承包商如何能够在激烈竞争的国内外承包市场保持和扩大市场份额，赚取更多的利润，怎样利用国际惯例和准则去维护自己的合法权益，是目前函待研究和探索的问题。本文在前期文献分析的基础上，首先对工程索赔的相关理论进行了研究，而后紧接着对工程索赔的现状以及问题进行了进一步的研究，工程索赔需要按照工程合同中的条款进行，反过来工程合同又可以作为工程索赔的相关依据。在对工程索赔的研究过程中，本文提出了当前国内工程索赔普遍存在建筑工程设计、建筑施工合同存在缺陷、不可抗力因素普遍等方面的问题，并结合文献资料以及自身实践经验尝试提出了相关解决对策并总结了建设工程项目索赔的技巧，希望可以给工程管理人员提供一些参考。关键词：建设工程项目工程索赔问题技巧AbstractThe concept of claim for construction project is divided into broad sense andnarrow sense.The claim for a broad construction project includes both the claim fromthe contractor to the owner and the claim from the owner to the contractor.The narrowsense refers only to the claim Fangyinfei contract due to extension of time and increasedcost to owner claim.The claim for construction projects described in this article refersonly to a narrow sense of claim.With the rapid development of economy,the internationalization of engineeringcontracting has been deepened,and the claim cases related to engineering projects havebeen increasing.This reflects the imperfect system and regulations in China.How canour contractors contract and maintain market share and earn more profits?How to makeuse of international conventions and norms to safeguard their legitimate rights andinterests.Based on the analysis in the previous literature,firstly the related theory ofengineering claim is studied,and then followed by a further research on the presentsituation and problems of project claim,the engineering claims need projects inaccordance with the terms of the contract,on the basis of relevant project contract inturn can be used as engineering claims.In the course of the study of engineering claims,this paper put forward the current domestic construction claim common constructioncontract design,building construction defects,force majeure factors common problems,combined with the attempts to put forward the relevant countermeasures andsummarizes the construction project claims the skills of literature and the practicalexperience,the hope can provide some reference to the project management staff.Keywords:Construction project,project claim,problem,skill
