中共重庆市委党校（重庆行政学院）专业学位顾士论文摘要进入新时代以来，国家针对营商环境的改善和优化作出重大部署，出台了一系列利于市场主体健康发展的政策法规，以此推动营商环境健康发展。健康的营商环境呈现出法治、有序的特征，因此，在对营商环境进行优化的过程中需要运用法治手段。邻水县地理位置优越，产业体系完善，在“成渝地区双城经济圈”机遇下，需要更多优质企业入驻，以此使商业市场更具活力，但是该县并不能吸引更多的经济支持和技术支持，因此，其营商建设的法治程度相对较低，以至于制约了当地经济发展，所以需要摸清邻水县营商环境法治建设存在问题，并对此建言献策，使县级地区在法治建设方面有据可依。本研究运用了对比分析法、文献法等三种方法，本研究的理论基础有区域性经济与法治政府等，本研究主要针对邻水县地区营商环境领域的法治建设工作而展开的。首先，对“营商环境”及“法治建设”“成渝地区双城经济圈”等概念进行界定。其次，了解邻水县域情况，通过问卷、访谈等方式调查分析营商环境法治建设现状，梳理出目前邻水县营商环境法治建设存在政策供给和要素保障不足、政务服务信息壁垒难打通、行政监管执法问题较凸出、法律服务建设不完善、缺乏与时俱进的知识产权保护体系等问题，究其原因为制度设计执行不到位、政府职能转变不彻底、行政执法权责不清、监管不力、缺乏健全的审判机制以及完善的法律保障，信用体系建设工作薄弱。接下来，本文对我国多个县级营商环境领域的法治建设工作进行了进一步介绍。最后提出加强邻水县营商环境法治建设的对策建议，即“优化营商制度和加强要素供给”、“持续优化服务和提高行政效率”、“强化监管执法和创新监管方式”、“拓展法律服务和提速破产审判”和“依法保护产权和建设诚信邻水”。关键词：营商环境；法治；成渝地区双城经济圈中共重庆市委党校（重庆行政学院）专业学位硕士论文AbstractSince entering the new era,the state has made major deployments for theimprovement and optimization of the business environment,and has issued a series ofpolicies and regulations that are conducive to the healthy development of marketentities,focusing on building a market-oriented,legalized,and internationalized businessenvironment.The rule of law is the best business environment,and the optimization ofthe business environment must be guaranteed by the rule of law.Linshui has anadvantageous geographical location and a complete industrial system.Under theopportunity of the "Chengdu-Chongqing Double-City Economic Circle",morehigh-quality enterprises are needed to enter the market to stimulate marketvitality.However,the county is mostly at the end of capital,talent,and technologyradiation.There exist some shortcomings in the construction of rule of law of thebusiness environment,which restricts the local economic development.Therefore,it isnecessary to find out the problems in the construction of rule of law of the businessenvironment in Linshui,and provide suggestions and thus provide newthoughts,opinions,and ideas for the legal construction of the business environment ofthe whole country.By mainly adopting literature analysis method,empirical analysis method andcomparative analysis method,this article will study the construction of rule of law of thebusiness environment in Linshui based on the theoretical basis of a law-basedgovernment,service-oriented government,and regional economy.First,defining theconcepts of "business environment","rule of law",and "Chengdu-ChongqingDouble-City Economic Circle".Second,serving to understand the present situation ofthe construction of rule of law of the business environment in Linshui,which will beinvestigated and analyzed through questionnaires,interviews,etc..Apart from lack ofpolicy supply and element guarantees in the construction of the business environmentof Linshui,the difficulty of opening up government service information barriers,andprominent issues of administrative supervision and law enforcement,there remain lessobvious effects of legal services and bankruptcy trials.Additionally,the protection ofintellectual property rights and the construction of the social credit system are laggingbehind.The reasons include inadequate system design and implementation,incompletetransformation of government functions,unclear administrative law enforcement powersand responsibilities,inadequate supervision,incomplete legal services and bankruptcy中共重庆市委党校（重庆行政学院）专业学位硕士论文trial mechanisms,inadequate attention to intellectual property protection and socialcredit systems.Then,introducing the beneficial experience of Kunshan and otherdomestic counties in the construction of rule of law of businessenvironment.Finally,proposeing countermeasures and suggestions to improve theconstruction of rule of law of business environment in Linshui,namely "optimizing thebusiness system and strengthening the supply of elements","continuously optimizingservices and improving administrative efficiency","strengthening supervision and lawenforcement,and innovating supervision methods","expanding legal services andspeeding up bankruptcy trialsand"and "protecting property rights in accordance withthe law,and building an honest Linshui".Key words:business environment;rule of law;Chengdu-Chongqing Double-CityEconomic Circle
