广州大学松田学院2020届毕业论文（设计）摘要2020年3月3日，中办国办颁发的《关于构建现代环境治理体系的指导意见》，对环境治理现代化提出新的目标和要求，在“一带一路”背景下，跨国企业的环境法律责任作为环境治理现代化和生态文明假设的的重要环节亟需在理论和实践中得以突破。“一带一路”倡议的提出，迎合了我国企业“走出去”的经济政策，加速了我国企业发展模式的转变，延长了企业的生产链，拉动了我国与沿线周边国家的经济往来。“一带一路”发展战略提出的同时，也给“一带一路”沿线的周边合作国家带来了环境风险。许多跨国企业为了谋求最大的经济效益，仍然以传统的牺牲当地的生态环境为代价的企业发展模式，不愿意主动肩负起自身的环境法律责任。而走可持续发展的道路和建设绿色“丝绸之路经济带”是全世界的共识，跨国企业在进行海外投资活动中除了谋取自身的经济发展外，更要兼顾生态环境问题。如何在“一带一路”的背景下平衡好跨国企业经济收益和企业如何承担自身的环境法律责任两者的关系是跨国企业投资者需要解决的终极问题。本文将通过研究跨国企业如何在“一带一路”背景下肩负起企业自身的环境法律责任而展开讨论。关键词：一带一路，跨国企业，环境风险，可持续发展，海外投资，环境法律责任广州大学松田学院2020届毕业论文（设计）Environmental Legal Responsibility Of The MultinationalEnterprises Under The "Belt and Road"StrategyAbstract:On March 3,2020,China Central Office issued the "guidance on theConstruction of Modern Environmental Governance system",which puts forward newgoals and requirements for the modernization of environmental governance.Under thebackground of "Belt and Road",the environmental legal responsibility of multinationalenterprises as an important link of environmental governance modernization andecological civilization hypothesis needs to be broken through in theory and practice.Theproposal of"Belt and Road"caters to the economic policy of "going out"of Chineseenterprises,accelerates the transformation of the development mode of Chineseenterprises,prolongs the production chain of enterprises,and stimulates the economicexchanges between China and the neighboring countries along the route.TheDevelopment Strategy of "Belt and Road"At the same time,it also brings environmentalrisks to the neighboring cooperative countries along the "Belt and Road".In order to seekthe greatest economic benefit,many multinational enterprises still take the traditionalenterprise development model at the expense of the local ecological environment,and areunwilling to take the initiative to shoulder their own environmental legal responsibility.And taking the road of sustainable development and building green "Silk Road EconomicBelt"is the consensus of the whole world,and multinational enterprises should take intoaccount the ecological environment problems in carrying out overseas investmentactivities in addition to seeking their own economic development.How to balance theeconomic benefits of multinational enterprises under the background of"Belt and Road"and how to bear their own environmental legal liability The relationship between thetwo is the ultimate problem that multinational enterprise investors need to solve.Thispaper will discuss how multinational enterprises should shoulder their own environmentallegal responsibility under the background of"Belt and Road".广州大学松田学院2020届毕业论文（设计）Key Words:"Belt and Road"Strategy,Transnational Enterprises,EnvironmentalRisks,Sustainable Development,Overseas Investment,Environmental Legal Liabilit
