本科论文目录摘要Abstract.…引言…1人身保护令制度的概述1.1人身保护令的含义312人身保护令的历史发展31.3人身保护令的内容…42人身保护令在我国反家暴中的适用52.1我国首例人身保护令的颁发22我国人身保护令在适用中的问题3国外人身保护令制度概述3.1日本人身保护令制度83.2德国人身保护令制度3.3美国人身保护令制度93.4我国台湾地区人身保护令制度3.5总结与借鉴104人身保护令制度的完善4.1加大保护范围…4.2对暴力范围进行全面界定..124.3增设人身保护令的法律后果结论.15参考文献…致谢.本科论文摘要家庭暴力成为全世界普遍关注的重要问题，这种行为在危害个人人身安全的同时，也会给家庭成员以及社会带来严重影响。关于抵制家庭暴力，联合国指出各国政府承担着重要的责任，同时规定国际公约签署国依照规定应实施立法干预，其中大多数国家为了防治家庭暴力都实施了人身保护令相关制度。2016年3月1日，我国《反家庭暴力法》正式颁布实施，该法在第四章中对人身保护令作出了规定，另外我国政府为了预防家庭暴力也作出很大努力，家暴现象有所改善，但是由于人身保护令颁布时间较短，条文规定具有局限性，在适用中出现一些问题，无法在最短时间内有效的制止家庭暴力。本文通过比分析总结国内外人身保护令的实行情况，归纳出我国人身保护令在适用中的不足，并提出合理的完善意见。本文从以下几个方面展开论述：首先，简要介绍了人身保护令，叙述人身保护令历史演进情况；其次通过总结人身保护令的实施状况，揭示出其中存在的问题：然后结合他国及我国台湾地区适用人身保护令制度的情况进行对比研究：最后提出完善人身保护令制度的建议，更好的保护受害人身心健康，促进家庭和谐，社会和谐。关键词：人身保护令：完善建议：家庭暴力：反家暴法本科论文AbstractNowardays domestic violence has become one of the world's mostimportant issues.This kind of misbehavior not only endangers personal safety,but also does harm to family members and society.In order to the fight againstdomestic violence,the United Nations put forward that governments should bearthe corresponding responsibility.At the same time,it stipulated that countriessigning the international conventions should implement legislative interventionaccording to the provisions.Most countries have imposed and implement theregulations ensuring to prevent domestic violence after that.On March 1,2016,China's Anti-Domestic Violence Law was officially enforced.In the fourthchapter,habeas corpus is fitted by law.In addition,with the great efforts madeby Chinese government the phenomenon of domestic violence reduced.However,as the law has just been issued and the provisions have limitations,there appears some problems in the application that cannot effectively stopdomestic violence.By comparing the implementation of habeas corpus both athome and abroad,this paper summarizes the deficiencies of habeas corpus inChina,and brings forward reasonable suggestions.Following aspects are discussed in this thesis:first,it briefly introducesthe habeas corpus in historical evolution order;second,it reveals the existingproblems by summarizing the implementation of the habeas corpus;then itmakes a comparative study on the application of the habeas corpus within thecorrelational studies in Taiwan and overseas finally,it proposes to improve thehabeas corpus to protect the physical and mental health of victims,promotefamily harmony and social harmony.Keywords:habeas corpus;optimization of suggestion;domestic violence;Anti-Domestic Violence Law
